Bangalore: The marriage institution or marriage or marriage system in the society is made for the birth of children, i.e. procreation of children. The sections in the Hindu Marriage Act, the Muhammadan Muslim Marriage Act and the Special Marriage Act regarding the institution of marriage or marriage are clear that marriage is between a man and a woman.
If this marriage is between a man and a man and a woman and a woman and not between recognized genders, i.e. between a man and a woman, then the purpose of marriage is lost here, because there will be no scope for having children.
Now the case of Sam Six Marriage is under hearing in the Supreme Court, legal activist and lawyer advocate of the High Court Anwar Ali shed more light on this matter.
The legalization of same-sex marriage is currently being debated in India and the Supreme Court resumed the hearing on April 27 after the arguments remained inconclusive.
Earlier on April 27, the SC had asked the Center to come back on May 3 with its reply on the social benefits that can be given to same-sex couples even without legal recognition of their marital status. The court raised the question after observing that the Centre’s acceptance of the right to live with same-sex partners as a fundamental right places an “equal responsibility” on it to recognize its social consequences. Homosexuals from across the country have approached the Supreme Court in which it has been said that same-sex marriages should be legalized under the Special Marriage Act.
A five-judge constitution bench headed by Chief Justice DY Chandrachud, while hearing a batch of pleas seeking legalization of same-sex marriage, took cognizance of the Centre’s submissions, represented by Solicitor General Tushar Mehta, that “right to love”. “The right to live together, the right to choose one’s partner, the right to choose one’s sexual orientation” is a fundamental right.
